1. General Provisions

The VA Fleurs online service (https://vafleurs.pl/) operates in accordance with the rules specified in these Terms and Conditions.

These Terms and Conditions define the types and scope of services provided electronically on the website https://vafleurs.pl/, the rules for providing these services, the conditions for concluding and terminating agreements for electronic services, and the procedure for handling complaints.

Every user of the website using electronic services on https://vafleurs.pl/ is obliged to comply with these Terms and Conditions.

In matters not regulated by these Terms and Conditions, the following generally applicable laws of Poland shall apply:

2. Definitions

  • Business Day – any day from Monday to Saturday, excluding public holidays.
  • Contact Form – a form available on the website https://vafleurs.pl/ that allows direct contact with the Service Provider.
  • Order Form – an interactive form available in the Online Store that allows placing an order by adding products to the cart and defining the terms of the sales contract, including the method of delivery and payment.
  • Customer – a natural person with full legal capacity, and in cases provided for by generally applicable law, also a natural person with limited legal capacity; a legal person or an organizational unit without legal personality, to which the law grants legal capacity, who concludes or intends to conclude a sales contract with the Seller.
  • Civil Code – the Act of April 23, 1964 – Civil Code (Journal of Laws 1964, No. 16, item 93, as amended).
  • Product – a movable item available in the Online Store, which is the subject of a sales contract between the Customer and the Seller.
  • Terms and Conditions – these Terms and Conditions of the Online Store.
  • Online Store – the online store operated by the Service Provider at https://vafleurs.pl/.
  • Sales Agreement – a contract for the sale of a Product concluded between the Customer and the Seller via the Online Store.
  • Service Provider / Seller – VA Fleurs sp. z o.o., with its registered office in Warsaw, ul. Hoża 86, lok. 410, 00-682 Warsaw, entered in the register of entrepreneurs under KRS number: 0000744921, NIP: 5213837167, REGON: 381015070, email address: contact@vafleurs.pl, phone: +48 790 343 461.
  • Service User – any person using the services of the Online Store.
  • Electronic Service – a service provided electronically by the Service Provider to the Customer via the Website.
  • Order – a declaration of the Customer’s will submitted via the Order Form, directly aiming to conclude a sales contract for the Product with the Seller.

3. Types and Conditions of Electronic Services

The Service Provider enables the use of the following electronic services on the website https://vafleurs.pl/:

  • Contact Form – allows the Customer to contact the Service Provider directly.
  • Order Form – the ordering process begins with adding a Product to the cart and ends by clicking the "Place Order" button. Until this moment, the Customer can modify the entered data.
  • Using the Order Form is free of charge and is a one-time service – it ends either upon placing an order or upon cancellation by the Customer.

4. Conditions for Concluding a Sales Agreement

The sales agreement between the Customer and the Seller is concluded after placing an Order via the Order Form.

The prices of the Products in the Online Store are expressed in Polish zlotys and include all applicable taxes. Information on delivery costs and additional charges is provided during the ordering process.

The sales agreement is concluded once the Seller sends an order confirmation to the Customer’s email address.

5. Payment Methods and Terms

Available payment methods:

  • Bank transfer to the Service Provider’s account.
  • Cash payment upon personal collection.
  • Electronic payments processed via PayU.pl.

If the Customer selects bank transfer or online payment, they are required to make the payment within 1 business day from the conclusion of the sales agreement.

6. Delivery and Order Fulfillment Time

Product delivery is subject to a fee unless the sales agreement states otherwise. Delivery costs are provided during the ordering process.

Available delivery methods:

  • Courier delivery.
  • Personal pickup: ul. Koszykowa 63, 00-667 Warsaw.
  • The delivery date is agreed upon individually with the Customer.

7. Complaint Procedure

Complaints regarding electronic services can be submitted via email to shopvafleurs@gmail.com.

A response to the complaint will be provided within 24 hours. If an order cannot be fulfilled due to the Seller's fault, the Customer will receive a full refund. If the Customer refuses to accept the shipment, the order is considered fulfilled.

8. Intellectual Property

All content posted on the website https://vafleurs.pl/ is protected by copyright and is the property of VA Fleurs. Any use of this content without the consent of the Service Provider is subject to civil and criminal liability.

9. Final Provisions

Agreements concluded via https://vafleurs.pl/ are governed by Polish law.

If any provision of these Terms and Conditions is found to be inconsistent with applicable legal regulations, the relevant legal provisions shall apply instead.
